PS, 侵權的主張, 應該是著作權人本人, 而非代理商, 因此, 得利只能建議 or 偕同原著作權人, 對未經同意輸入的行為興訟, 得利並不能主動為之 ... 因此, 若處處依 "代理" 的角度來思考問題, 法律上是說不通的!!

A:關於禁止真品平行輸入，所謂未經過著作財產權人的同意不得輸入。
該著作財產權人包括是日本著作財產權人及其臺灣的獨家代理商
台灣的獨家代理商一樣是算著作財產權人...所以它也能主動提起訴訟...
